Abstract: The Protection of Cultural Heritage or Properties from Transboundary
Removal under International Law

The protection of cultural heritage or properties from removal out of the

State of origin requires international cooperative measures. In this regard,
the applicable rules of international law are based on two following directions.
The first one comes from the UNESCO 1970 Convention on the Means of
Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership
of Cultural Property which aims at prohibiting the export of specified cultural
properties. However the implementation of this Convention so far has been
unsatisfactory because of its numerous limitations. Consequently the second

direction is adopted and enshrined in the UNIDROIT 1995 Convention on Stolen
or Illegally Exported Cultural Objects is destined to complement the UNESCO
Convention by imposing the obligations for each State party to enact national
legislation that specifically adopts similar principles on the return and
compensation of cultural properties. Although, some legal obligations under
the UNIDROIT Convention are still subject to certain restrictions, the success
of this Convention resides in the fact that it raises awareness of the world
community and brings about the current increasing number of contracting parties
as importing States to this Convention.
