235 ศั กดา ธนิ ตกุล วารสารราชบัณฑิตยสภา ปีที่ ๔๑ ฉบับที่ ๒ เม.ย.-มิ.ย. ๒๕๕๙ เอเอ็มแอลไม่ได้อธิบายหรือให้ค� ำนิยามถึงความแตกต่างระหว่างพฤติกรรมที่เกี่ยวกับราคา (price-related conduct) กับพฤติกรรมที่ไม่เกี่ยวกับราคา (non-price related conduct) ซึ่งท� ำให้มี การทับซ้อนของเขตอ� ำนาจหน้าที่ของเอ็นดีอาร์ซี และเอสเอไอซี ๒๕ ๓. พฤติกรรมการแข่งขันที่เอเอ็มแอลห้ามกระท� ำ พฤติกรรมการแข่งขันที่เอเอ็มแอลห้ามมิให้ผู้ประกอบธุรกิจกระท� ำแบ่งออกเป็น ๔ กลุ่ม พฤติกรรมตามภาพรวมขององค์กรบังคับใช้กฎหมายข้างต้นได้ ดังนี้ (๑) ความตกลงจ� ำกัดการแข่งขัน (Anti-Competition Agreement) (๒) การใช้อ� ำนาจเหนือตลาดอย่างไม่เป็นธรรม (Abuse of Dominance) (๓) พฤติกรรมต่อต้านการแข่งขันที่ไม่เกี่ยวกับราคา (Non-Price Related Anti-Competition Conduct) (๔) การใช้อ� ำนาจปกครองอย่างไม่เป็นธรรมเพื่อจ� ำกัดการแข่งขัน (Abuse of Administrative Power to Restrict Competition) ๓.๑ ความตกลงจ� ำกัดการแข่งขัน [Anti-Competitive (“Monopoly”) Agreement] ความตกลงจ� ำกัดการแข่ งขันถูกบัญญัติตามเอเอ็มแอล ว่ าเป็น “Monopoly agreement” ซึ่งเป็นพฤติกรรมที่ถูกห้ามคล้ายกับ Article 101 ของสนธิสัญญาการท� ำงานของสหภาพยุโรป (the Treaty on the Functioning of the European Union) พฤติกรรมที่ถูกเอเอ็มแอลห้ามกระท� ำนั้น เป็นไปตามบทบัญญัติของมาตรา ๑๓ ๒๖ ๒๕ เพิ่งอ้าง ๒๖ Article 13 ของ เอเอ็มแอล บัญญัติว่า “Competing undertakings are prohibited from concluding the following monopoly agreements : (1) on fixing or changing commodity prices ; (2) on restricting the amount of commodities manufactured or marketed ; (3) on splitting the sale.s market or the purchasing market for raw and semi-finished materials ; (4) on restricting the purchase of new technologies or equipment, or the development of new technologies or products ; (5) on joint boycotting of transactions ; and (6) other monopoly agreements confirmed as such by the authority for enforcement of the Anti-monopoly Law under the State Council. For the purposes of this Law, monopoly agreements include agreements, decisions and other concerted conducts designed to eliminate or restrict competition.”
