การช่วยเหลือผู้แสวงหาที่ลี้ภัยซึ่งประสบภัยในทะเล 22 The Journal of the Royal Society of Thailand Volume 40 Number 4 Oct-Dec 2015 Abstract The Assistance for Refugees in Distress at Sea Jaturon Tirawat Associate Fellow of the Academy of Moral and Political Science, The Royal Society, Thailand Giving assistance to refugees in distress at sea is obligatory under international law of both conventional and customary natures, which obliges the flag Stateand coastal State to give assistance and co-ordinate their efforts in the search and rescue operations of the refugees and deliver them to the safe places, regardless of their nationality, status and situation in which they were found. The problem encountered in practice arises, however, from the unclearness and the incompleteness of the governing rules of law relatingto the scope of obligations to render assistance to refugees, making it possible for coastalStates to deny the right of the refugees in distress at sea to land on their shores and settle downon their soil. Hence, this problem has thus far been resolved by distributing the burdensamong different countries. However, the success of the solution to this problem is contingenton the large scale co-operation between different countries, especially the countries of departureand those of destination, including the third countries and relevant international organizations,given that such a problem is of an international nature. Thus, the solution to the problemcould not be left solely under the responsibility of flag State that bears such a burden for humanitarian reason.
